Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Zultic ("Zultic", "we", "us", or "our") governing your use of the MyPlushies app and the website atmyplushies.app (together, the "Service"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who Can Use MyPlushies

You must be at least 16 years old, or such higher age as required by the laws of your country, to use the Service. By using the Service, you confirm that you meet this requirement. The Service is not intended for children below this age.

2. What MyPlushies Does

MyPlushies is a mobile application that lets you catalog and keep track of your plushie (plush toy) collection. You can add plushies to a personal collection, organize and browse them, and record details about each item. Your collection data is stored in your own iCloud account using Apple's CloudKit (see Section 4).

We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

3. No Account Required

MyPlushies does not require you to create an account or sign in. You can use the app's features without registering or providing personal identifiers to us.

4. Your Data and iCloud (Apple CloudKit)

The Service uses Apple CloudKit to store and sync your collection data. This means:

• Your data is stored in your own iCloud account, which is governed by Apple's iCloud Terms and Conditions and Apple's Privacy Policy.
• Zultic does not operate the servers where this data is stored and does not independently host or control your iCloud data.
• Syncing depends on your device settings and your iCloud account. If iCloud is disabled, your data may be stored only locally on your device.
• You are responsible for your Apple ID and the security of your iCloud account.

You can delete your data at any time within the app or by managing your iCloud storage through your Apple device settings. Deleting the app does not necessarily delete data already stored in your iCloud account.

5. Subscriptions and Payments

Some features of MyPlushies may require a paid subscription ("MyPlushies premium" or similar). Subscription offers are presented in the app (the paywall experience is powered by Superwall), and purchases are processed by Apple through your App Store account. If you choose to subscribe:

• Billing. Your subscription is sold and billed through your Apple App Store account. The price and available plans are shown in the app before you purchase.
• Auto-renewal. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before the period ends. Your Apple account is charged for renewal within 24 hours before the current period ends.
• Free trials. If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.
• Managing and cancelling. You can manage or cancel your subscription at any time in your Apple account settings (Settings → your name → Subscriptions). Deleting the app does not cancel a subscription.
• Refunds. Purchases are handled by Apple and are subject to Apple's terms. Refund requests are processed by Apple, not by Zultic.
• Changes. We may change subscription features or pricing for future periods. Material changes are communicated as required and apply on renewal.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates applicable laws or regulations, or infringes others' rights
• Abuse, reverse-engineer, decompile, overload, or disrupt the Service
• Attempt to gain unauthorized access to any part of the Service or its systems
• Introduce viruses or other malicious code
• Use any robot, spider, or automated means to access the Service in a way that burdens it
• Use the Service to build a competing product or dataset, or resell access to the Service

7. Your Content

You retain ownership of any content you create or add in the app (such as photos or details about your plushies). Because this content is stored in your own iCloud account via CloudKit, it generally remains under your control and is not collected by Zultic.

To the extent the app processes your content in order to operate (for example, displaying it back to you within the app), you grant us a limited, non-exclusive license to do so solely for the purpose of providing the Service to you. You are responsible for the content you add and confirm that you have the right to use it and that it does not violate any law or third-party right.

8. Intellectual Property

The Service, including its design, code, artwork, and the MyPlushies name and logo, is owned by Zultic and protected by copyright, trademark, and other laws. These Terms do not grant you any rights to our branding. You may not copy, modify, distribute, or create derivative works from the Service, or use our trademarks, without our written permission.

MyPlushies is an independent application and is not affiliated with, endorsed by, or sponsored byany plush toy manufacturer, brand, franchise, or character owner. Any third-party names or trademarks referenced by users remain the property of their respective owners.

9. Apple App Store Terms (Licensed Application End User License Agreement)

MyPlushies is made available through the Apple App Store. Your license to use the app is governed by Apple's standard Licensed Application End User License Agreement (EULA), available at:

You acknowledge and agree that, in addition to these Terms:

• These Terms are between you and Zultic only, and not with Apple. Apple is not responsible for the app or its content.
• The license granted to you for the app is a non-transferable license to use the app on any Apple-branded device that you own or control, as permitted by the App Store Usage Rules.
• Apple has no obligation to provide any maintenance or support services for the app. Any maintenance or support is provided by Zultic.
• In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• Zultic, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and consumer protection or privacy claims.
• Zultic, not Apple, is responsible for investigating and resolving any third-party claim that the app infringes intellectual property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how the Service handles data. By using the Service, you agree to the practices described in the Privacy Policy.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OR RELIABILITY. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any data will always be available or preserved.

12. Limitation of Liability

To the fullest extent permitted by law, Zultic will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, profits, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim is limited to the greater of the amount you paid us (if any) for the Service in the 12 months before the claim, or USD 50.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including your statutory consumer rights.

13. Termination

You may stop using the Service at any time and delete the app. We may suspend or end your access to the Service if you breach these Terms or to protect the Service or other users. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected here with a new effective date, and, where required by law, we will provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules, and subject to any mandatory consumer protections of your country of residence. Any disputes arising from these Terms or the Service will be resolved in the courts located inthe State of California, United States, except where applicable law requires otherwise.

16. Severability and Entire Agreement

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy and (for the app) Apple's standard EULA, constitute the entire agreement between you and Zultic regarding the Service.
